Privacy Policy, Terms & Copyright NOTICE

Last Updated: October 14, 2026

This Privacy Policy, Website Terms, and Copyright Notice applies to bairashaburova.com and photography services provided by Bairta Shaburova, professionally known as Baira (“Photographer,” “I,” “me,” or “my”).

By accessing or using this website, you acknowledge this Privacy Policy and these Website Terms. Submitting an inquiry does not create a booking or photography services agreement.

Photography sessions are governed by a separate signed Photography Services Agreement. If the signed agreement conflicts with information presented on this website, the signed agreement will control.

1. Information I Collect I may collect personal information that you voluntarily provide, including:

Your name;

Email address and phone number;

Information submitted through the contact form;

Session preferences and requested dates;

Names or information concerning session participants;

Location and scheduling details;

Clothing, styling, or visual references you choose to share;

Signed agreements, invoices, and payment records;

Communications sent by email, Instagram, or other messaging services.

The website and its service providers may also automatically collect limited technical information, such as your IP address, browser type, device type, referring page, pages visited, and general website usage information.

2. How Your Information Is Used

Your information may be used to:

Respond to inquiries;

Discuss and plan photography sessions;

Prepare agreements and invoices;

Schedule and manage bookings;

Provide styling and location recommendations;

Deliver proof and final galleries;

Communicate about payments, scheduling, and delivery;

Maintain tax, accounting, and business records;

Improve the website and client experience;

Protect legal rights and comply with legal obligations.

I do not sell or rent personal information.

3. Cookies and Website Analytics

This website and its hosting providers may use cookies or similar technologies that are necessary for website operation, security, analytics, and performance. You may limit or disable cookies through your browser settings. Some website features may not function properly when cookies are disabled.

4. Third-Party Service Providers

I may use third-party providers to operate the website and photography business, including:

Website hosting services;

Online gallery platforms;

Email and communication services;

Contract and electronic-signature services;

Payment providers;

Scheduling tools;

Analytics and security services.

These providers may process information according to their own privacy policies. I only share information that is reasonably necessary to provide the requested service, operate the business, comply with the law, or protect legal rights.

Payment providers may collect payment information directly. I may retain transaction records, but I do not necessarily receive or store complete payment-card information.

5. Contact Forms and Communications

When you submit the contact form, you consent to being contacted regarding your inquiry. Submitting the form does not reserve a session date and does not require you to book a session.

I do not add clients or website visitors to marketing mailing lists without their consent.

Email, website forms, Instagram, and other electronic communications cannot be guaranteed to be completely secure. Please do not send sensitive financial, identity, or medical information unless it is specifically required and an appropriate method has been provided.

6. Booking, Payments, and Rescheduling

A session date is not reserved until I have received:

A signed Photography Services Agreement;

and The required $50 reservation retainer.

The reservation retainer is credited toward the total Session Fee. It is generally non-refundable because it reserves the session date and compensates for planning, administrative work, and declined booking opportunities.

Unless an invoice or signed agreement states otherwise, the remaining balance is due no later than 24 hours before the scheduled session.

A client may request one rescheduling without losing the reservation retainer when written notice is provided at least 48 hours before the session. The replacement session must normally take place within 60 days of the original date and is subject to availability. A second client-requested rescheduling requires a new $50 reservation retainer. Requests made less than 48 hours before the session or failure to attend may be treated as a cancellation. Genuine emergencies may be considered individually.

For outdoor sessions, weather-related rescheduling approved by the Photographer does not count as the client’s permitted rescheduling. Payments will transfer to the replacement date.

If I must cancel and we cannot agree on a replacement date, all payments made directly to me, including the reservation retainer, will be refunded.

Complete and controlling payment, cancellation, and rescheduling terms are provided in the signed Photography Services Agreement.

7. Locations, Studios, and Additional Expenses

Studio rental is not included in the photography Session Fee unless expressly stated in the Session Summary or invoice.

Studio rental, admission, permit, parking, travel, hair and makeup, wardrobe, printing, and other third-party expenses are the client’s responsibility when applicable and approved in advance.

I may assist with selecting a studio or location that fits the planned light, atmosphere, concept, and budget.

8. Proof Gallery and Image Selection

A curated private proof gallery will normally be provided within approximately 5–7 days after the session.

The client will select the number of photographs included in the purchased package. The selection should normally be completed within seven calendar days after receiving the proof gallery.

Final editing begins after the complete selection has been submitted. Proof images are unfinished previews. They may not be downloaded, screenshot, edited, shared, published, or posted on social media. Additional edited images may be purchased if the client would like more photographs than the selected package includes.

9. Editing and Final Delivery

Final editing includes color correction and natural retouching consistent with my portfolio and artistic style.

Editing does not include major body alteration, extensive object removal, compositing, or other complex manipulation unless agreed to separately. Additional editing fees may apply.

RAW files, unedited images, test images, technical failures, duplicates, and complete outtakes are not delivered.

Final edited photographs will normally be delivered within approximately 2–2.5 weeks after the client submits the complete image selection. Delivery times are estimates and may be reasonably extended because of illness, emergency, unusual workload, technical problems, or circumstances outside my control.

The final online gallery will remain available for three months from the delivery date. Clients are responsible for downloading and safely backing up all delivered photographs before the gallery expires.

After the three-month period, I am not required to retain the gallery, proof images, RAW files, or final photographs, and file restoration may not be possible.

10. Client Gallery Privacy and Security

Client galleries may be delivered through a third-party online gallery service and may be accessible through a private link, password, email address, or other access information.

Clients are responsible for sharing gallery links and access information carefully. I am not responsible for unauthorized access resulting from a client sharing the gallery link, password, or downloaded files with another person.

No online storage or transmission system can be guaranteed to be completely secure.

11. Portfolio Use and Session Privacy

Clients may choose whether selected photographs from their session may be used in my:

Website portfolio;

Social media;

Studio samples;

Publications;

Exhibitions;

Competitions;

Advertising and promotional materials.

This choice is recorded in the Photography Services Agreement.

I will use identifiable session photographs for portfolio or promotional purposes only when the client has provided the applicable written permission.

A client may choose to keep the session private. Choosing privacy does not change the Session Fee or the services provided.

Clients are responsible for ensuring that other adult participants have agreed to participate in the session and to any authorized portfolio use. A parent or legal guardian must provide the necessary permission for participating minors.

12. Copyright and Client Image License

I retain the copyright in all photographs created during a session unless a separate written agreement expressly states otherwise.

For portrait, couple, and family sessions, clients receive a non-exclusive license to download, display, share, and print the delivered final photographs for personal, non-commercial use.

Personal brand sessions may include limited promotional use by the client’s own business, as described in the signed Photography Services Agreement.

Unless written permission has been provided, delivered photographs may not be:

Sold or licensed;

Used by another business;

Used in paid commercial advertising;

Materially altered or edited;

Modified with filters;

Submitted to publications;

Used for artificial-intelligence training;

Provided to third parties for commercial use;

Presented as the work of another photographer.

14. Children’s Privacy

This website is not directed to children under 13, and I do not knowingly collect personal information directly from children under 13.

Parents and legal guardians may provide information concerning their children when inquiring about or arranging a photography session.

If you believe a child has submitted personal information without appropriate permission, please contact me so the information can be reviewed and, where appropriate, deleted.

15. Data Retention and Privacy Requests

Personal information is retained only for as long as reasonably necessary to:

Respond to inquiries;

Provide photography services;

Maintain transaction, tax, and business records;

Fulfill contractual obligations;

Resolve disputes;

Protect legal rights;

Comply with applicable law.

Depending on your place of residence, you may have the right to request access to, correction of, or deletion of certain personal information.

Deletion requests may be limited when information must be retained for contractual, tax, accounting, legal, security, or dispute-resolution purposes.

To submit a privacy request, please use the contact information at the bottom of this page. I may need to verify your identity before completing certain requests.

16. Security

I use reasonable administrative and technical measures to protect personal information.

However, no website, electronic communication, gallery platform, or storage system can guarantee absolute security. Information is provided and transmitted at the user’s own reasonable risk.

17. Website Availability and Limitation of Liability

Website content is provided for general informational purposes and may be corrected, updated, or removed at any time.

I do not guarantee that the website will always be available, uninterrupted, secure, or free from technical errors.

To the fullest extent permitted by law, I am not responsible for indirect, incidental, special, or consequential damages arising solely from the use or temporary unavailability of this website.

Liability concerning paid photography services is governed by the signed Photography Services Agreement.

Photography services are governed by the applicable signed Photography Services Agreement.
